1) Acceptance of Terms

These Terms & Conditions (the "Terms") govern your access to and use of E-Atom's website, mobile applications, and services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

2) Definitions

• "We", "us", "our" means E-Atom, having its registered office at Vidyanagar, Karad - 415124.
• "You" or "User" means any person who accesses, browses, or uses the Platform.
• "Product(s)" means goods and/or services offered for sale on the Platform.
• "Seller" means E-Atom or any third‑party seller listing Products on the Platform (where applicable).

3) Eligibility & Account

• You must be at least 18 years old and competent to contract to use the Platform.
• You are responsible for maintaining the confidentiality of your account credentials and restricting access to your device.
• Information you provide must be accurate, current, and complete. Notify us of any changes promptly.
• We may suspend or terminate accounts for suspected fraud, misuse, or violation of these Terms.

4) Products, Orders & Pricing

• Product images, descriptions, and specifications are for guidance. Minor variations may occur.
• All prices are shown in INR (₹) and inclusive/exclusive of applicable taxes as indicated. GST invoice provided where applicable.
• We may correct pricing/availability errors and cancel orders affected by such errors, with a full refund where payment was captured.
• Your order is an offer to buy; acceptance occurs when we dispatch the Product(s) and send a dispatch confirmation.
• We reserve the right to limit quantities and refuse or cancel any order at our sole discretion.

5) Payments & Billing

• We accept the payment methods shown at checkout (e.g., credit/debit cards, UPI, net‑banking, wallets, Cash on Delivery where available).
• By providing payment information, you represent that you are authorized to use the chosen method and authorize us to charge the order total.
• For COD orders (if available), additional fees/limits may apply and we may verify order details before dispatch.
• In case of payment failure or chargebacks, we may suspend or cancel the order and/or your account.

6) Shipping, Delivery & Risk

• Estimated delivery timelines are displayed at checkout and may vary due to carrier delays or events beyond our control.
• Risk of loss passes to you upon delivery to the shipping address provided. Title transfers upon full payment.

7) Returns, Refunds & Cancellations

• Our return window is 7 days from delivery.
• Items must be unused, in original condition and packaging, with all tags, manuals and accessories.
• Refunds are processed to the original payment method within 5–7 business days after quality inspection.
• We may offer replacement or store credit instead of refund where appropriate.
• Order cancellations are permitted until before dispatch; after that, please use the return process.

8) Warranties & Disclaimers

Unless expressly stated, Products are provided "as is" and "as available". Manufacturer warranties (if any) apply as specified by the manufacturer. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non‑infringement.

9) Limitation of Liability

To the fullest extent permitted by law, in no event shall E-Atom be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of the Platform or purchase of Products. Our aggregate liability for any claim shall not exceed the amount you paid for the Product giving rise to the claim.

10) Indemnity

You agree to defend, indemnify, and hold harmless E-Atom and its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to your violation of these Terms, misuse of the Platform, or infringement of any third‑party rights.

11) Intellectual Property

The Platform and all content, logos, trademarks, graphics, and software are owned or licensed by E-Atom and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Platform without prior written permission.

12) Reviews & User Content

• You are solely responsible for content you submit (reviews, ratings, comments, images, etc.).
• You grant us a worldwide, royalty‑free, irrevocable, perpetual, sublicensable license to use, reproduce, modify, publish, translate, and display such content in connection with the Platform and our business.
• We may remove or edit content that is unlawful, misleading, infringing, defamatory, or otherwise objectionable.

13) Prohibited Uses

Without limitation, you agree not to:

• Use the Platform for any unlawful purpose or in violation of applicable laws and regulations.
• Interfere with or disrupt the integrity or performance of the Platform or its data.
• Upload or transmit viruses, malware, or harmful code.
• Attempt to gain unauthorized access to accounts, systems, or networks.
• Engage in fraudulent activity, including payment fraud or return abuse.

14) Third‑Party Services & Links

The Platform may contain links to third‑party websites or services that are not owned or controlled by us. We are not responsible for their content, policies, or practices. Your use of third‑party services is at your own risk and subject to their terms.

15) Privacy & Data Protection

Please review our Privacy Policy to understand how we collect, use, share, and protect your personal information. By using the Platform, you consent to our data practices as described therein.

16) Communications (SMS/Email)

• By creating an account or placing an order, you consent to receive transactional communications (e.g., order updates, delivery notifications).
• Marketing messages are sent only with your consent and you may opt out at any time via the unsubscribe link or account settings.
• Standard carrier charges may apply for SMS messages.

17) Promotions, Coupons & Gift Cards

• Promotional offers and coupon codes are subject to their specific terms, cannot be combined unless stated, and may be withdrawn without notice.
• Gift cards/store credit are non‑refundable and may expire or be subject to fees as permitted by law. Treat them like cash; lost or stolen cards may not be replaced.

18) Subscriptions & Auto‑Renewal (if applicable)

• If you enroll in a subscription, it will automatically renew at the end of each term unless canceled before renewal.
• You authorize recurring charges to your selected payment method for each renewal period.
• You can cancel at any time via your account settings; benefits remain available until the end of the paid period.

19) Marketplace Sellers (if applicable)

• Some Products may be sold by third‑party sellers. Seller of record and invoice details will be indicated at checkout or on the invoice.
• We may facilitate the transaction and logistics but are not a party to the sale between you and the seller unless explicitly stated.

20) Force Majeure

We shall not be liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, natural disasters, epidemics, strikes, wars, governmental actions, or failures of suppliers, logistics providers, or telecommunications.

21) Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India without regard to conflict of law principles. Subject to the arbitration clause below (if chosen), courts located in Karad,Maharashtra shall have exclusive jurisdiction.

22) Changes to Terms

We may update these Terms from time to time. Changes are effective when posted on the Platform with a revised "Last updated" date. Continued use of the Platform after changes constitutes your acceptance of the revised Terms.
